ActivistARC Terms of Service

Operator: Activist Technologies PBC, a Delaware Public Benefit Corporation 1. Introduction and Agreement to Terms: These Terms of Service govern your access to and use of the Activist ARC mobile application, website, services, features, and content. By creating an account, accessing the Service, or tapping Accept, you agree to be bound by these Terms. If you do not agree, you must not use the Service. You represent that you are at least eighteen years old and legally able to enter into this agreement. These Terms constitute a binding contract between you and Activist Technologies PBC. The Service may be modified, suspended, or terminated at any time at our discretion. 2. About ActivistARC: ActivistARC is a civic engagement platform providing tools, data, and resources related to voting, legislation, public policy, and elected officials. The Service may provide personalized recommendations, research tools, action prompts, and communication features. The Service integrates with third party data sources. We do not guarantee accuracy, completeness, or availability of third party data. 3. Eligibility and Account Registration: To use certain features, you must create an account. You agree to: (a) provide accurate and complete information; (b) maintain the confidentiality of your credentials; and (c) accept responsibility for all activities under your account. We may suspend or terminate an account for violations of these Terms, unlawful conduct, fraud concerns, or to protect platform integrity. 4. Identity Verification through Persona: Some features require completing identity verification through Persona. By using verification, you authorize Persona and Activist Technologies PBC to collect and process identification data. Verification does not guarantee access to all features or compliance with laws. 5. User Conduct and Acceptable Use: You agree not to: interfere with operation of the Service, access without authorization, or attempt to breach security; upload harmful code or use automated scraping tools; misuse civic or political data for prohibited electioneering, voter suppression, misinformation, or manipulation; extract or reproduce data provided through TargetSmart, BallotReady, or other APIs; impersonate others or misrepresent your identity; submit unlawful, harmful, defamatory, infringing, or misleading content; engage in commercial or competitive use of the Service; attempt reverse engineering, decompiling, or creating derivative works of the Service. 6. User Content: You may submit content such as comments, notes, actions, preferences, and uploads. You grant Activist Technologies PBC a nonexclusive, worldwide, royalty-free, sub-licensable license to use, reproduce, distribute, modify, adapt, and display your content for operation and improvement of the Service. You represent that you own or control all necessary rights. 7. Third Party Services and Data: The Service retrieves information from third parties such as TargetSmart, BallotReady, Vote Smart, and government APIs. We disclaim responsibility for inaccuracies, delays, outages, or errors in third party data. Your use of such data must comply with the terms of the respective providers. 8. Intellectual Property Rights: All content, software, designs, text, algorithms, data structures, and trademarks associated with the Service are owned by Activist Technologies PBC or its licensors. You are granted a limited, nonexclusive, revocable license to use the Service for personal, lawful, noncommercial purposes. No rights are transferred to you. 9. No Legal Advice: The Service offers civic tools and informational content only. It is not legal advice. You are responsible for independently verifying information before acting on it. 10. Disclaimers: The Service is provided “as is” and “as available.” Activist Technologies PBC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, noninfringement, accuracy, and availability. We do not warrant uninterrupted access, completeness of data, or that recommendations will produce any outcome. 11. Limitation of Liability: To the fullest extent permitted by law, Activist Technologies PBC shall have no liability for any damages, including direct, indirect, incidental, consequential, punitive, exemplary, or special damages arising out of or relating to your use of the Service. Some jurisdictions may not permit total exclusions; in such cases, liability is limited to the minimum extent required by law. 12. Indemnification: You agree to defend, indemnify, and hold harmless Activist Technologies PBC and its officers, directors, employees, and affiliates from any claims arising from your use of the Service, your content, or your violation of these Terms or applicable law. 13. Arbitration and Class Action: Waiver All disputes shall be resolved through binding arbitration administered by the American Arbitration Association. You waive any right to a jury trial or to participate in a class or representative action. Disputes will be resolved individually. 14. Termination: We may terminate or suspend your access at any time for any reason, including legal obligations, policy violations, or security risks.
